1. Acceptance of Terms

By accessing or using PersonaAI, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

PersonaAI provides an AI Persona Generation and Hosting Platform. Our service allows users to:

Create digital personas from chat logs, content samples, and voice recordings
Host and interact with AI-powered personas
Access AI-generated responses based on trained persona models

We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice.

3. User Responsibilities

You agree to use our service responsibly and lawfully:

Lawful Use - Use the service only for legal purposes and in compliance with all applicable laws
No Impersonation - Do not use PersonaAI to impersonate real people without their consent
Account Security - Maintain the confidentiality of your account credentials
No Interference - Do not interfere with the proper operation of the service
Content Ownership - Ensure you have the right to use any content you submit for persona training

4. Billing and Payment

Credit Packs - Credit packs (e.g., Starter Pack at $4.99 for 50 generations) are one-time purchases with a 30-day validity period from the date of purchase. Unused credits expire after 30 days and are non-refundable.

Payment Processing - All payments are processed securely through Creem, our designated payment processor and Merchant of Record (MoR). Creem handles all payment processing, tax compliance, and subscription management on our behalf.

Auto-Renewal - Credit packs do not auto-renew. If you purchase a new credit pack, it is a separate one-time transaction.

Currency - All prices are listed in USD unless otherwise specified.

5. Intellectual Property

Your Data - You retain full ownership of all data you provide to PersonaAI, including chat logs, content samples, and voice recordings.

Your Personas - The AI personas you create are yours. You own the outputs generated by your personas.

Our Platform - PersonaAI and its underlying technology, trademarks, and intellectual property remain our exclusive property.

6. Limitation of Liability

AI Content Responsibility - You are solely responsible for how you use AI-generated content from your personas. PersonaAI does not control or endorse the outputs generated by AI personas.

No Warranty - The service is provided "as is" without warranty of any kind. We do not guarantee that AI responses will be accurate, appropriate, or error-free.

Damage Limitation - To the maximum extent permitted by law, PersonaAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

7. Termination

You may terminate your account at any time through your account settings or by contacting support. Upon termination:

Your unused credits will be forfeited upon account termination
Your data will be retained for 30 days before permanent deletion
You can request immediate deletion by contacting support

We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

8. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation or legally compliant dispute resolution processes.
